As currently described by industry advocates, without congressional action, the Section 781 hemp implementation deadline on November 12, 2026, could make many hemp-derived wellness products federally unlawful. Supporters are urging Congress to extend that deadline by two years—from November 12, 2026, to November 12, 2028—to provide additional time for implementation and regulatory clarity.
Why This Matters
Since the 2018 Farm Bill, hemp has become an important part of the wellness industry. Consumers rely on hemp-derived products—including CBD tinctures, gummies, topicals, mushroom blends, pet wellness products, and other hemp-based supplements—as part of their everyday wellness routines. Industry groups now say the upcoming implementation deadline could dramatically reduce the availability of many products currently sold under existing hemp regulations if Congress does not approve an extension.
